Terms of Service

1. What nthreader does

nthreader provides email Signals that indicate how many recipients opened an email before the current recipient. Signals are displayed via images embedded in emails.

2. Acceptable use

You agree not to misuse the service. For example, you must not:

• Send illegal emails or use Signals for unlawful activity
• Send spam or unsolicited bulk email
• Use Signals in a deceptive, misleading, or harmful way
• Attempt to probe, scan, or test the security of the service
• Interfere with service operation or bypass usage limits

You are responsible for complying with applicable laws and regulations (including CAN-SPAM, GDPR, and similar email and privacy laws).

3. Responsibility for recipients

You are responsible for your recipient lists and your communications. This includes ensuring you have a lawful basis to email recipients, informing recipients where required, and obtaining consent where applicable.

nthreader is not responsible for the sources of your mailing lists or your compliance obligations.

4. Service limitations & accuracy

• Signal counts are best-effort estimates and may not reflect every open.
• Email client, proxy, caching, and privacy features may affect detection and ordering.
• We do not guarantee email delivery, open detection, or specific results.

5. Subscriptions & billing

• Plans, pricing, and usage limits are described on the pricing page.
• If paid plans are available, you authorize us (and our payment processor) to charge applicable fees.
• Unless required by law, fees are non-refundable.

6. Suspension & termination

• We may suspend or terminate access if you violate these Terms or to prevent abuse.
• We may limit the service to protect platform stability and other users.
• You may stop using the service at any time.

7. Intellectual property

• nthreader and its software, design, and branding are owned by us or our licensors.
• You retain ownership of content you provide to the service (e.g., Signal titles and configuration).
• We grant you a limited, non-exclusive, revocable license to use the service under these Terms.

8. Disclaimer of warranties

The service is provided “as is” and “as available”. We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, nthreader will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill.

To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us for the service in the 3 months before the event giving rise to the claim.

10. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll update the effective date and may notify account holders via the app or email.
